1. Definitions and interpretation
"Agreement": these terms and conditions of business ("T&Cs") pertaining to Services.
"Client": person to whom Services are provided.
"Company": Total Health Ethos Limited (company number XX) with registered office at 1a Christmas Steps, Bristol, BS1 5BS;
“Practitioners”: the Practitioners who deliver the Services at the Company’s premises
"Services": services to be provided under the Agreement which include chiropractic, osteopathy, physiotherapy, sports injury therapy, massage, and acupuncture.
"Appointment Pass": voucher purchased by Client for the provision of Services at reduced fees.
"Working Hour": every hour between 8am and 9pm Monday to Friday and 9pm and 1pm Saturday apart statutory holidays in place where Services are provided.
2. Fees and costs
2.1 Fees payable by Client for Services shall be the fees chargeable by the Practitioners for such Services current at the date of provision. The Company is entitled to collect and receive fees on behalf of the Practitioners.
2.2 Fees payable by Client for an Appointment Pass shall be the fees chargeable by Company current at the date of provision.
3. Terms of payment
3.1 Except where otherwise agreed in writing fees for Services shall be due and payable by Client immediately following provision of the Services.
3.2 Except where otherwise agreed in writing fees for Appointment Pass shall be due and payable by Client in advance of receiving Services. The total amount must be paid in full and is non-refundable.
3.3 Appointment Pass is valid for 12 months.
4. Cancellations
4.4 The cancellation and/or re-scheduling fees below shall apply to cancellation or re-scheduling of any appointment by Client. Company shall issue a supplementary fee invoice to Client for such cancellation and/or re-scheduling fees and Client shall make full payment to Company within 30 days of date of that invoice:

4.2 If a client has an Appointment Pass an appointment which is cancelled or postponed with less than 4 Working Hours notice will be deducted from the remaining entitlement on the Pass.
5. Provision of Services
Company's catalogues, brochures, leaflets or other correspondence including information published on Company's website are not binding and reasonable variations may be made to Services without notice, and Services so varied shall be accepted as complying with Agreement. Company reserves the right to cancel, curtail or re-schedule medical services without notice to Client and in such instance. Company reserves right to refuse Services or provide reduced Services to Client for any reason.
6. Limitation of liability
Nothing in this Agreement limits either party's liability for death or personal injury due to negligence or fraudulent misrepresentation. Except as set out in this clause, Company shall not be liable for lost profits, loss of business, loss caused by supply of inaccurate information or any omitted information by Client, any consequential, punitive, incidental or indirect loss or damages, whether any claims for such damages are based on tort or contract and whether Company knew or should have known the possibility of such damages. Company's total aggregate liability under this Agreement for any losses or damages shall not exceed total price payable for Services.
7. Warranties and representations
Each party warrants and represents that, as at date of this Agreement, it has full capacity and authority to enter into this Agreement. If requested, Company may help Client to choose medical services or other Services but Company does not provide any warranties that such Services will be fit for Client's purpose and assessment and selection of Services remains Client's ultimate responsibility. No statement, description, information, condition or recommendation contained in any Company catalogue, price list, website, advertisement or communication or made verbally by representatives of Company shall be construed to vary in any way any of the terms of this Agreement. All other warranties (express or implied) are hereby excluded to maximum extent permitted by applicable law.
8. Modifications and additional terms
9.1 Modifications to these T&Cs: Company reserves right to modify these T&Cs without prior notice. When changes are made, Company will post changes on this page of Company's website (www.themedicalbristol.co.uk/terms).
9. Governing law and dispute resolution
The Agreement shall be governed by English Law. Any dispute under this Agreement shall be submitted to the exclusive jurisdiction of English courts.
10. Other terms
10.1Force majeure: Company shall be entitled to delay or cancel delivery of Services or to reduce the amount of Services delivered if it is prevented from or hindered in or delayed in the provision of Services through any circumstances beyond its reasonable control including strike, lock-out, accident, war, government action, national emergency, act of terrorism, protest, riot, civil commotion, explosion, flood, epidemic, fire.
10.2 Company's privacy statement at www.themedicalbristol.co.uk/privacy will apply.
10.3 Company may assign or sub-contract its obligations or rights under this Agreement to a competent third party in whole or in part.
Terms
Cancellation policy
At THE Medical, we are happy to cancel or move appointments. We do request, however, at least 24 working hours notice (this does not include Saturdays, Sundays, or national holidays).
Clients that cancel or postpone treatments within 24 working hours of the agreed appointment will be charged equivalent to the full price.
Clients will also be charged in full if they fail to attend an appointment without notificartion.
